New weapon is Holy Grail of electronic warfare

The holy grail of electronic warfare has made it's debut.  Boeing’s Phantom Works demonstrated its Counter-electronics High-powered Microwave Advanced Missile (CHAMP) last month over the Utah Test and Training Range.  The advanced missile successfully defeated electronic targets with little to no collateral damage when tested on an unoccupied building in the Utah desert.  The CHAMP weapon discharged a burst of High Power Microwaves onto the unoccupied test building and brought down the the entire spectrum of electronic systems; disabling the camera recording the test in the process.

This new missile is an important development and it adds a powerful punch to the U.S. weapons arsenal.  The missile renders enemy radar inoperable and permanently destroys electronic equipment.  It is said that CHAMP can penetrate underground bunkers, disable fighter planes, tanks, ships, and missile systems.  It's similar to a miniature electromagnetic pulse (EMP) bomb, except CHAMP can be used to take out the electronic systems we want to render useless.  EMP's will affect a wide area, depending on altitude of explosion, energy yield and gamma ray output.  CHAMP uses a selective high-frequency radio wave to target enemy electronics.

This new weapon would allow our air-force to penetrate the airspace of our enemies at will and grant unimpeded access to our bombers to destroy targets at will.  If the United States fails to confront the Iranians in their quest for nuclear weapons, and instead places that burden on the Israelis, then the next President of the United States must offer this weapon to the Israeli military.  If the Israelis had the CHAMP weapon system and some advanced bunker-busting bombs, they could defend themselves much easier than they can at present.

CIA operators were denied request for help during Benghazi attack

Fox News has learned from sources who were on the ground in Benghazi that an urgent request from the CIA annex for military back-up during the attack on the U.S. Consulate and subsequent attack several hours later was denied by U.S. officials -- who also told the CIA operators twice to "stand down" rather than help the ambassador's team when shots were heard at approximately 9:40 p.m. in Benghazi on Sept. 11.

Colin Powell questions a Romney foreign policy?




Former Chairman of the Joints Chiefs of Staff Colin Powell endorsed President Barack Obama for a second term Thursday, telling “CBS This Morning” that he voted for Obama in 2008 but this time was going further and publicly backing him.  One of the reasons Mr. Powell endorsed President Obama is because he has concerns with a Romney foreign policy.  "I'm not quite sure which Governor Romney we would be getting with respect to foreign policy," Powell stated. “One day he has a certain strong view about staying in Afghanistan but then on Monday night he agrees with the withdrawal — same thing in Iraq.”

I guess he likes the way Obama conducts his foreign policy.  People don't remember that Colin Powell shared some responsibility for the deaths of Americans in Mogadishu during Clinton's term.   A Senate report into a disastrous 1993 Army raid in Somalia portrays Gen. Colin Powell bending to pressure to keep U.S. involvement to a minimum when field commanders sought greater firepower. The report quotes Gen. Wayne Downing, head of the United States Special Forces, as saying "we were under incredible pressure" from the Joint Chiefs of Staff.  "I advised that I would like to have the AC-130s," he said. "Gen. Powell advised that we needed to keep the numbers down."  Powell was rightly criticized for refusing to send AC-130 gunships along with Task Force Ranger, a force of 460 Army troops to reinforce the troops that were trying to capture the Somali warlord.

In the end, 18 America soldiers were killed and many more injured.  I guess Colin Powell had a case of amnesia, because he later said he didn't recall that his officers on the ground requested the reinforcements...even though he was the Chairman of the Joint Chiefs of Staff.  Judging by Powell's past decisions, I can see why he would prefer Obama's weak foreign policy over one of strength.

Is Benghazi Obama's Mogadishu?


Secretary of State Hillary Clinton on Monday attempted to take one for Team Obama. While in Lima Peru, Secretary Clinton stated, "I take responsibility, I'm in charge of the State Department's 60,000-plus people all over the world, 275 posts. The president and the vice president wouldn't be knowledgeable about specific decisions that are made by security professionals. They're the ones who weigh all of the threats and the risks and the needs and make a considered decision."

Is Hillary Clinton the new Les Aspin?  In 1994, then Secretary of Defense Les Aspin, was ousted from the Clinton administration in large part because of the failed raid in Mogadishu Somalia (Blackhawk Down) and his decision not to send tanks.  According to a Senate Armed Services Committee report on the deaths of 18 U.S. service members, Defense Secretary Les Aspin and his deputies rejected sending needed tanks and armored vehicles to Somalia because they feared a political backlash would undermine their pro-United Nations policy.







Fast forward to 2012. The late Ambassador Stevens and the diplomatic mission in Libya made multiple security related requests that were turned down by Washington based officials.  Ambassador Stevens even wrote in his diary that he feared for his safety shortly before he and three other Americans were murdered by terrorists.  Lt. Col. Andrew Wood has stated that U.S. Ambassador Stevens wanted a Security Support Team, made up of 16 special operations soldiers, to stay with him in Libya after their deployment was scheduled to end in August. The embassy staff’s first choice was for us to stay and "that would have been the choice of the embassy people in Tripoli” Lt. Col. Andrew's continued.

Why would the Obama administration deny adequate security to our diplomatic team in Libya?  Especially during the 11th anniversary of 9/11 and in a country rife with anti-American Islamists.   Liberals have this unfounded view that if the United States keeps a low profile and doesn't project power, then somehow our enemies will like us and not try to kill us.  President Obama has spent the better part of four years apologizing to Muslim extremists; projecting weakness in the process.

Benghazi is Obama's Mogadishu, the only difference is 18 Army Rangers died in Somalia and four diplomats died in Libya.  Defense Secretary Les Aspin took the blame for Bill Clinton's failed foreign policy in 1994 and Hillary Clinton is attempting to take the blame for Obama's failed foreign policy today.  

I find it ironic that a 2008 Hillary Clinton campaign ad featured a telephone ringing at 3 a.m. It strongly suggested that Barack Obama was not prepared to take that phone call at that critical hour. Somewhere a crisis would mount, and she wanted primary voters to understand that the inexperienced Illinois senator was not ready to tackle it.  That 3 a.m. phone did in fact ring..and Obama didn't answer, Hillary did, and they both failed miserably.

Muslims Rape and Kill American Ambassador and Three Other Americans


This is the thanks you get when you help a Muslim country gain their freedom.  President Obama praised the "Arab Spring" and led from behind to help the Libyans gain their freedom.  The Muslims that dragged our Ambassador through the streets in Libya are of a lower life form than most humans.  US Ambassador Christopher Stevens was trying to leave the consulate building for a safer location as part of an evacuation when gunmen launched an intense attack, apparently forcing security personnel to withdraw.  "The American ambassador and three staff members were killed when gunmen fired rockets in their direction," a Libyan official in Benghazi told Reuters.






Obama threw our long time ally, Hosni Mubarak, under the bus last year in favor of the Muslim extremists in Egypt and they have slapped us in the face ever since.  After the Egyptians stormed our embassy in Cairo, Obama's State Department (Embassy in Cairo) released a statement saying that it condemns “the continuing efforts by misguided individuals to hurt the religious feelings of Muslims — as we condemn efforts to offend believers of all religions.”  This weak statement was rightly condemned by presidential candidate Mitt Romney.  Hours after the apologetic statement, Muslim terrorists stormed our consulate in Benghazi and Killed the ambassador and three other Americans.

President Obama's foreign policy is misguided and dangerous to our national interests.  He goes out of his way to avoid offending the very people that hate us.  The perception of Barack Obama in the Middle East is one of weakness and that weakness only invites more aggression towards America.  Mr. Obama has made many mistakes in that part of world and it exposes the fact he is in way over his head.  We cannot afford four more years of this type of weak foreign policy.  God bless the Americans that were killed by Muslims and God bless their families.

Obama's America 2016 expands to 1,075 theaters. Complete list of theaters and times of showings.


The documentary “2016: Obama’s America,” will be expanding to 1,075 theaters this weekend, much to the chagrin of the Obama regime.  Obama's America is already the number two grossing documentary of 2012 with a gross of $2 million nationwide.  It's being reported that many online movie listing sites and local news papers are not listing the times of showings, or are just not listing the location of the movie at all.

The Hollywood Reporter is reporting that some in Hollywood are stumped by the amount of business the documentary did at the Regal Union Square Stadium 14 in lower Manhattan, situated in a liberal neighborhood where films from the likes of Moore have done huge business.  Hollywood Reporter goes on to state that Obama's America was the No. 3 film of the weekend behind The Dark Knight and Totall Recall at Union Square, prompting at least one film executive to joke that people must have thought it was a pro-Obama documentary (New York is the No. 1 city when it comes to the amount of giving to the Obama campaign).

Former Clinton White House Chief of staff praises Ryan budget.

Former Clinton White House Chief of staff praises Congressman Paul Ryan's proposed budget.  Erskine Bowles served as White House Chief of staff from 1997-1998 and is known for being the Democratic co-chair for President Obama's National Commission on Fiscal Responsibility and Reform.  President Clinton appointed Bowles to head the Small Business Administration in 1993 and then Bowles served as Clinton's   White House Deputy Chief of Staff, before becoming the Chief of staff in 1997.

In the video below Mr. Bowles states, “Have any of you all met Paul Ryan? We should get him to come to the university. I’m telling you this guy is amazing. ... He is honest, he is straightforward, he is sincere. And the budget that he came forward with is just like Paul Ryan. It is a sensible, straightforward, serious budget and it cut the budget deficit just like we did, by $4 trillion. … The president as you remember, came out with a budget and I don’t think anybody took that budget very seriously. The Senate voted against it 97 to nothing." 

This is a pretty strong endorsement from a prominent Democrat and his quote will no doubt end up in a Romney ad.  I doubt the mainstream Obama media will report this endorsement because it doesn't fit their narrative and it may hamper their efforts to re-elect Barack Obama.

Ted Cruz sails past Dewhurst for giant victory!




Tonight’s victory by Ted Cruz just goes to show money can't always buy what you want.  Lite Governor Dewhurst loaned his campaign nearly $25 million during this campaign just so he could claim the title of Senator.  It is amazing that a candidate with virtually no name recognition could out raise a sitting Lt. Governor and then trounce him in a runoff election.  This illustrates one important point.  Texans are sick and tired of moderate Republicans that claim to be Conservative when election time rolls around.  David Dewhurst threw everything but the Battleship Texas at Ted Cruz, but the voters saw this sham for what is was.

Ted Cruz, the longest serving Solicitor General in Texas history, will now face former Democratic state Rep. Paul Saddler in the November match up.  Mr. Saddler beat perennial candidate Grady Yarbrough to capture the Democratic Party nomination.  It must be pointed out that no Democrat has been elected to statewide office in Texas since 1994.  That being said, Ted Cruz can most likely start measuring the drapes for his new office.    I can only imagine the jubilation Rafael Cruz (Ted Cruz’s father) must feel right about now.  Rafael journeyed from communist Cuba to the United States with only $100 sewn into his underwear.  Now he has the opportunity to see his son serve in the United States Senate.

I would like to congratulate Ted Cruz for a fine campaign and I hope he will make all Conservatives (Texas and beyond) very proud.  There is a real chance that Barack Obama gets re-elected and if that nightmarish scenario actually occurs, we will need people like Ted Cruz to fend off Obama’s socialist agenda.  Gird your loins; November will be an exciting time and one that will shape America's future for decades to come.

Sherrif Joe Arpaio's Obama birth certificate press conference

Maricopa County Sheriff Joe Arpaio held a press conference Tuesday and released the detailed information his team gathered in regards to the authenticity of President Barack Obama's birth certificate.  Cold Case Posse lead investigator Mike Zullo walked through the evidence gathered during the course of the investigation and illustrated the many problems with the birth certificate that was released by Obama's attorney's  During the course of the investigation Mr. Zullo discovered a weak link in the Hawaiian birth certificate process.  This flaw (Statute 338-17.8) allows anyone with the intent to obtain a birth certificate to get one with relative ease.  This new revelation has serious implications in regards to illegal immigrants or terrorists obtaining birth certificates in Hawaii and thus becoming American citizens.  Watch the press conference and make up your own mind as to whether the Obama birth certificate is real or forged.

Is Obama ready to launch air strikes on Syria?

It's being reported in some circles the Obama administration is gearing up for a limited airstrike on the Assad regime and to impose a no-fly zone to curtail the Syrian Air Force.  Pressure is building on the Obama administration to take action as the mass killings continue.  General Dempsey, the Chairman of the Joints Chiefs of Staff, warned in May that Syria could face armed intervention as international outrage grows over the massacres of Syrian women and children.  Defense Secretary Leon Panetta has said he does not see the United States taking military action in Syria without the backing of a UN Security Council resolution and there is doubt Russia and China would allow such a resolution to pass.

Political calculations must be considered since Obama is in heat of a re-election campaign.  If the mainsteam media would have covered Obama's Libyan intervention, like they would have if a Republican President had done the same, it would be pointed out that mission was a failure.  Obama can claim that he lead from behind and helped oust Dictator Muamar Gaddafi, but he would be remiss not to mention the low level civil war that now consumes Libya and their many factions.  He would also be remiss not to mention the many anti-aircraft missiles and other weapons that were looted from Libyan stockpiles.  The weapons in question will be used against Israel by Hamas and Hezbollah in any future hostilities.  Some of the looted rockets have already been used against Israel last October by Hamas resulting in the death of at least one Israeli.

If Assad is toppled by a limited military intervention the chances are high chemical weapons, Scud missiles and other Russian weaponry will be looted by Muslim fanatics.  Assad may also choose to release stores of weapons to Hezbollah during an attack on his regime, only to be used against Israel.  Limited air strikes may suppress the roving murderous Syrian army, but unless we get boots on the ground and take control of their weapon stockpiles, then these dangerous weapons will end up in the hands of Israel's enemies.  There is little evidence Obama or the international community has the appetite for the military intervention required to make such a mission a long term success.  These likely scenarios have most certainly been debated ad nauseam in the White House, but there is no telling what a President will do to cling to power, whether that President is Obama or Assad.

Liberals become unhinged after loss in Wisconsin

The left was soundly defeated in their effort to recall Wisconsin Governor Scott Walker and they are now becoming unhinged.  In this video a liberal cries like a baby while he declares "Democracy died tonight."

  


Twitchy.com published angry tweets from liberals advocating the murder of Governor Scott Walker.  No word if Attorney General Eric Holder has started an investigation into the death threats against the Governor.  If the angry tweeters turn out to be members of the racist New Black Panther Party then they will have no reason to worry because Eric Holder will drop the charges against them.   


According to CBS News, after the loss in Wisconsin's gubernatorial election Tuesday night, Milwaukee Mayor Tom Barrett took another blow - literally - when one of his own supporters slapped him.  Watch the video as an emotional liberal slaps Mayor Barrett as he thanks his supporters.
   




MSNBC host Ed Schultz concluded in a wild assertion that Governor Walker "could very well be indicted in the coming day."  Indicted for what we don't know, but Ed Schultz is known to have crazy thoughts in his head so your guess is as good as mine.  If you think liberals have gone crazy now, just wait until Barack Obama is defeated this November.  I love to watch those on the left implode...it makes great entertainment.

Fox and Friends air video showing Obama's failures





Fox and Friends showed a video that illustrates the failures of Obama's first term much to the chagrin of  liberals.  I think what irks the freaks at Media Matters is that the video is so accurate and Fox actually had the nerve to show the truth about the failures of this administration.  The mainstream Obama media bash Mitt Romney and all conservatives every minute of every day, but we don't hear the whining from the left.  The Public Policy Polling released a poll several months ago that showed FNC was the most trusted TV news source and I'm sure that just adds salt to the wounds of the left.  My advice to liberals...put your big girl panties on and quit whining because you still control the mainsteam media and they will shamelessly carry Obama's water.

Ted Cruz forces runoff with David Dewhurst



Former state solicitor general Ted Cruz pulled off a surprise challenge to Texas Lt Governor Dewhurst last night and the Senate race now heads to a runoff.  With 40% of the vote reporting- David Dewhurst held a 47% to 32% advantage…failing to garner the 50% plus one to avoid a runoff.  One year ago very few people knew who Ted Cruz was, but just about all Texas voters knew of Lt Gov Dewhurst.   Dewhurst used millions of dollars of his own fortune and relied on name recognition in an effort to win what was thought to be a cake-walk for the Texas senate seat.  Ted Cruz was endorsed by conservative stalwarts from around the country, which included:  Senator DeMint, Sarah Palin, Freedom Works, Senator Rand Paul, Rick Santorum, The Conservative Cloakroom and many others. 

In a desperate attempt to cast doubt on Ted Cruz the moderate Dewhurst spent millions on untrue commercials in the final weeks of the campaign.  One of the commercials was a Moveon.org style retread commercial that lied about Ted Cruz's connection to a Chinese manufacturing lawsuit.  In the waning days of the campaign Team Dewhurst flat-out lied about Ted Cruz supporting amnesty for illegals.  Most Texans are not stupid enough to believe that the same Ted Cruz who successfully defended Texas' right to execute an illegal alien for the rape and murder of two Texas teens is somehow weak on illegal immigration.  David Dewhurst supported in-state tuition for illegal immigrants, waffled on the border fence, and refused to pass legislation fining Texas employers who hire illegal immigrants. 

The runoff will be held July 31 and if history is to be a guide Ted Cruz could have a slight advantage.  Most runoff elections have a low turnout and it's usually the diehard voters that participate in those elections.  Dewhurst no doubt received thousands of votes because many voters simply recognized his name on the ballot and those types of voters aren't usually the ones that turnout for runoffs.  Ted Cruz cannot and will not take this for granted because he knows David Dewhurst will say or do anything and spend millions of his own money to win this election.  Texas and the country cannot afford another moderate in the U.S. Senate.

FLASHBACK**Matt Lauer attacks President Bush for using gay marriage to get votes




The Obama media has gone to great lengths to make it appear President Obama has gone through some sort of cerebral evolution in regards to gay marriage.  Rush Limbaugh played a montage of the mainstream media touting Obama's evolution and how wonderful and groundbreaking it is.  Do they question why Obama has suddenly decided to bless gay marriage?  No, of course not. 

Flashback to the midterm elections during Bush's term.  Matt Lauer gets into a frenzy and accuses President Bush of using gay marriage to fire up conservatives.  Has Matt Lauer, or any another liberals in the media, accused Obama of using this issue to get votes?  In this video, Matt states to Ann Coulter, "if you ask people in this country what they're worried about, they say Iraq, gas prices...things like gay marriage are way down on the list, but that's what this president is talking about this week."  What are Americans worried about in 2012 Matt?  Gas prices, plummeting mortgages, Afghanistan, sluggish economy et al.

Lauer goes on to state, "But the president talked about it (gay marriage) in 2004 and never talked about it again..now, obviously we are in a election cycle...isn't this just an overt way to say to the social conservative base..look I will talk about it again, come out and vote for me."  Matt Lauer and the liberal media at large are total hypocrites and they're disgusting to watch.  When a Republican brings up gay marriage it's only to get votes and when a Republican changes sides on an issue it's flip-flopping.  When a liberal brings up gay marriage it's wonderful and when they change their minds it's called evolving.

Obama has evolved three or four times on this issue over the years and the media never seems to notice.  Matt Lauer asks Ann, "do you think George Bush in his heart cares strongly about this issue?"  Matt, do you think Obama in his heart cares strongly about this issue, or is he bringing this up now to get votes and campaign donations?

Obama's support for the 'Occupy' movement is telling


Why would any voter support an American President that voiced support for the anti-capitalist, Jew hating, socialist loving Occupy movement?  Barack Obama even went so far as to say "you’re (Occupy Movement) the reason I ran for office in the first place.”  Many leaders in the Democratic Party have voiced support for these dregs and attacked the peaceful Tea Party protests that preceded the 'Occupy' movement.  

The 'Occupy' thugs plan on disrupting traffic and commerce on the East and West coasts to celebrate May Day (International Workers' Day) and what do we get from the White House?  We get an Obama speech that is filled with class warfare rhetoric.  In many ways the modern day Democratic Party is the Occupy movement.  The Democratic Party is filled with socialists that share a disdain for capitalism.  The Democratic Party is filled with people (The Black Panthers, Union thugs, Eco-nuts) that think violence is okay if it helps advance their cause.  

President Obama has mocked and attacked those that support the Tea Party.  What is the Tea Party?  The Tea Party is a group of patriotic Americans that want the government to practice fiscal responsibility and adhere to the Constitution of the United States.  The Tea Party is comprised of black, white, Hispanic, Asian and Jewish people that think they're taxed too much.  You didn't see rapes, murders and violence at their rallies like you do with the Occupy' movement.  It's very telling that Obama and other Democratic Party leaders support the Occupy movement while they ridicule the Tea Party.  Unless you're a card carrying member of the modern day Nationalist Socialist Democratic Party, your decision on who to vote for this November should be very simple.

Racism vs Race-Baiting


The killing of Trayvon Martin by George Zimmerman is tragic indeed, but so are the countless other killings that happen everyday in our country.  There are people in our society that will seize upon this tragedy to advance their own cause and make the situation far worse than it needs to be.  The people I speak of are the same race-baiting whores we see time after time when something like this occurs.  Jesse Jackson, Al Sharpton and crazy Louis Farrakhan make a living on racism, whether that racism is real or imagined. 

The mainstream media and the other race-whores are calling the killing of Mr. Martin an act of overt racism.  The problem with this accusation is George Zimmerman is a Hispanic that grew up in a multiracial family.  Zimmerman has black American neighbors defending him telling the media that everything being reported was untrue and that she would trust George with her life.  Another black neighbor said that George was the only one, black or white, who came and welcomed her to the community, offering any assistance he could provide.  Of course those in the media don’t let the facts get in the way of a good story.  Reuters published a story today in which they called Zimmerman a “white” Hispanic.  Why do you think Reuters would go to the effort to label Zimmerman as a white Hispanic?  You and I both know the answer to this question and it’s a disgusting effort by ‘journalists’ to inflame the situation.  The media must create their own facts so it will fit their (white on black racism) narrative. 

Not to be outdone by the self proclaimed black leaders (Jackson, Sharpton, Farrakhan), the racist New Black Panther Party are doing all they can to foment fear and violence in Florida by offering a $10,000 bounty on the head of George Zimmerman.  The Black Panther leader, Mikhail Muhammad, has called for 10,000 black men willing to form a militia to find Mr. Zimmerman and administer what they regard as justice.  Asked if he was inciting violence, Mr. Muhammad stated, "An eye for an eye, a tooth for a tooth." To the sound of cheers from followers, who wore black uniforms, he promised: "If the government won't do the job, we'll do it."  President Obama has interjected himself into the controversy by saying, "If I had a son, he'd look like Trayvon” and that the nation needed to do some "soul searching" over the shooting death of an unarmed African-American teenager.  That’s all well and good, but I expect the President to try and calm the situation and he hasn’t done that as of yet.       

The point of my article is not to deny that racism exists or disavow that Black Americans are killed solely because of their race.  Black Americans are in fact killed because of their race, however, just not as much as the media and the race-whores would have you believe.  White Americans are killed by black people simply because they’re white, but of course it’s not reported as being overt racism perpetrated by Black Americans.  What I’m attempting to point out is the hypocrisy of those on the left who are trying to manufacture racism…facts be damned. 

I challenge these so called ‘civil rights’ leaders and groups to do something really brave.  Why don’t these people address the real crimes that are being committed against black youths every minute of every day?  What is that crime?  Black on black crime kills more black youths than all the racial based crimes combined in the history of our country.  The disturbing truth that continues to be swept under the rug is that Black American youths are killing themselves at highly disproportionate rates.  Homicide is the number one cause of death for Black American youth and young adults ages 10 to 24 and it’s not being committed by racist whites or racist white Hispanics.

I realize racism is a cottage industry for those in the civil rights movement, but if they really wanted to help their community they would address the real killers of their youth.  Black on black crime is not the only big killer of Black Americans.  While blacks make up only 13.6% of the U.S. population, they account for 50.3% of all diagnosed cases of HIV.  The rate of HIV diagnosis among black men is eight times that of whites and two times that of Hispanics, and the rate for black women is 19 times that of whites and four times that of Hispanics.  The black community is in dire need for real leadership, but unfortunately I don't see anyone stepping up to the plate.  All I see is self serving race-baiting whores and an accommodating media trying foment violence.

Is Texas Lt Gov. Dewhurst really a fiscal Conservative?

In the race to replace Senator Kay Bailey Hutchison we have heard many candidates claim to be fiscal, small government Conservatives.  Former Dallas Mayor Tom Leppert resigned his position about a year ago to make a run for Hutchison's seat and surprised many (even his own supporters) when he claimed to be a Conservative.  Lt. Governor Dewhurst has money and name recognition within the state, but is he really the fiscal, small government Conservative he claims to be?  The Ted Cruz campaign has released a new video showing just the opposite may be true.  Cruz, a former Texas state solicitor general, has a real record of being a staunch Conservative and has a long list of national Conservative leaders endorsing his candidacy.  When left-wing groups such as Thinkprogress.org label Cruz as "a radical attorney named Ted Cruz" you know he's doing something right.  During Lt Gov. Dewhurst's ten year reign the Texas Senate proposed $5.8 BILLION more in spending than the Texas House.  That is hardly the record of a fiscal, small government Conservative.

President Obama may be excluded from Georgia ballot


According to Congressman Tom Tancredo's website, President Obama may be excluded from the ballot in Georgia as a candidate for the election this November.  There was a lawsuit filed in Georgia against Mr. Obama in regards to his status as a "natural born citizen" and Obama's attorney, Michael Jablonski, decided not to show for the proceedings.  Mr. Jablonski declared that he will no longer participate in administrative court hearings on a challenge to Obama’s spot on Georgia’s presidential primary ballot.  The Georgia Secretary of State (Brian Kemp) responded to Obama’s attorney with the warning, “if you and your client (Obama) choose to suspend your participation in the OSAH proceedings, please understand that you do so at your own peril.”
     
The Judge in the case has said he will decide by Feb 5 whether or not he will recommend to the Georgia Secretary of State to exclude Obama from the ballot.  The Georgia Secretary of State has said he will follow the Judge's recommendation.  This ruling itself won’t really hurt Obama’s reelection efforts because Obama lost Georgia in 2008.  Georgia has 16 electoral votes up for grabs this election cycle and those will probably go to the GOP nominee with or without this ruling.  If the “Birthers” win this ruling in Georgia, it will no doubt inspire them to try this tactic in states that Obama needs to claim the 270 Electoral College votes to win the election.  This story is still developing so stay tuned!

Re: Georgia Presidential Preference Primary Hearings

Dear Secretary Kemp:

This is to advise you of serious problems that have developed in the conduct of the hearings pending before the Office of State Administrative Hearings. At issue in these hearings are challenges that allege that President Obama is not eligible to hold or run for re-election to his office, on the now wholly discredited theory that he does not meet the citizenship requirements. As you know, such allegations have been the subject of numerous judicial proceedings around the country, all of which have concluded that they were baseless and, in some instances – including in the State of Georgia – that those bringing the challenges have engaged in sanctionable abuse of our legal process.

Nonetheless, the Administrative Law Judge has exercised no control whatsoever over this proceeding, and it threatens to degenerate into a pure forum for political posturing to the detriment of the reputation of the State and your Office. Rather than bring this matter to a rapid conclusion, the ALJ has insisted on agreeing to a day of hearings, and on the full participation of the President in his capacity as a candidate. Only last week, he denied a Motion to Quash a subpoena he approved on the request of plaintiff’s counsel for the personal appearance of the President at the hearing, now scheduled for January 26.

For these reasons, and as discussed briefly below, you should bring an end to this baseless, costly and unproductive hearing by withdrawing the original hearing request as improvidently issued.

It is well established that there is no legitimate issue here—a conclusion validated time and again by courts around the country. The State of Hawaii produced official records documenting birth there; the President made documents available to the general public by placing them on his website. “Under the United States Constitution, a public record of a state is required to be given ‘full faith and credit’ by all other states in the country. Even if a state were to require its election officials for the first time ever to receive a ‘birth certificate’ as a requirement for a federal candidate’s ballot placement, a document certified by another state, such as a ‘short form’ birth certificate, or the certified long form, would be required to be accepted by all states under the ‘full faith and credit’ clause of the United States Constitution.” Maskell, “Qualifications for President and the “Natural Born” Citizenship Eligibility Requirement,” Congressional Research Service (November 14, 2011), p.41.

Nonetheless, the ALJ has decided, for whatever reason, to lend assistance through his office—and by extension, yours—to the political and legally groundless tactics of the plaintiffs. One of the attorneys for the plaintiffs has downloaded form subpoenas which she tried to serve around the country. Plaintiff’s attorney sent subpoenas seeking to force attendance by an office machine salesman in Seattle; seeking to force the United States Attorney to bring an unnamed “Custodian of Records Department of Homeland Security” to attend the hearing with immunization records; and asking the same U.S. Attorney to bring the same records allegedly possessed by “Custodian of Records of U.S. Citizenship and Immigration Services.” She served subpoenas attempting to compel the production of documents and the attendance of Susan Daniels and John Daniels, both apparently out of state witnesses, regarding Social Security records. She is seeking to compel the Director of Health for the State of Hawaii to bring to Atlanta the “original typewritten 1961 birth certificate #10641 for Barack Obama, II, issued 08.08.1961 by Dr. David Sinclair…,” even though Hawaii courts had dismissed with prejudice the last attempt to force release of confidential records on November 9, 2011. Taitz v. Fuddy, CA No. 11-1-1731-08 RAN.

In Rhodes v. McDonald, 670 F. Supp. 2d 1363, 1365 (USDC MD GA, 2009), Judge Clay Land wrote this of plaintiff’s attorney:

When a lawyer files complaints and motions without a reasonable basis for believing that they are supported by existing law or a modification or extension of existing law, that lawyer abuses her privilege to practice law. When a lawyer uses the courts as a platform for political agenda disconnected from any legitimate legal cause of action, that lawyer abuses her privilege to practice law….

As a national leader in the so-called ‘birther movement,’ Plaintiff’s counsel has attempted to use litigation to provide the ‘legal foundation’ for her political agenda. She seeks to use the Court’s power to compel discovery in her efforts force the President to produce a ‘birth certificate’ that is satisfactory to herself and her followers.” 670 F. Supp. 2d at 1366.

All issues were presented to your hearing officer—the clear-cut decision to be on the merits, and the flagrantly unethical and unprofessional conduct of counsel—and he has allowed the plaintiffs’ counsel to run amok. He has not even addressed these issues—choosing to ignore them. Perhaps he is aware that there is no credible response; perhaps he appreciates that the very demand made of his office—that it address constitutional issues—is by law not within its authority. See, for example, Flint River Mills v. Henry, 234 Ga. 385, 216 S.E.2d 895 (1975) [1]; Ga. Comp. R. & Regs. r. 616-1-2-.22(3).

The Secretary of State should withdraw the hearing request as being improvidently issued [2]. A referring agency may withdraw the request at any time. Ga. Comp. R. & Regs. r. 616-1-2-.17(1). Indeed, regardless of the collapse of proceedings before the ALJ, the original hearing request was defective as a matter of law. Terry v. Handel, 08cv158774S (Superior Court Fulton County, 2008), appeal dismissed, No. S09D0284 (Ga. Supreme Court), reconsideration denied, No. S09A1373. (“The Secretary of State of Georgia is not given any authority that is discretionary nor any that is mandatory to refuse to allow someone to be listed as a candidate for President by a political party because she believes that the candidate might not be qualified.”) Similarly, no law gives the Secretary of State authority to determine the qualifications of someone named by a political party to be on the Presidential Preference Primary ballot. Your duty is determined by the statutory requirement that the Executive Committee of a political party name presidential preference primary candidates. O.C.G.A. § 21-2-193. Consequently, the attempt to hold hearings on qualifications which you may not enforce is ultra vires.

We await your taking the requested action, and as we do so, we will, of course, suspend further participation in these proceedings, including the hearing scheduled for January 26.

President Barack Obama’s name will remain on the Georgia primary ballot after a state law judge flatly rejected legal challenges that contend he can not be a candidate.  According to FOX NEWS 19, despite the fact that he didn't come to court, and his lawyer refused to defend the case, President Barack Obama has won a case brought by several so-called "birthers" who sought to have him removed from the Georgia ballot for re-election on grounds that he is not a natural-born citizen of the United States.
